Is it legal to hire a private detective in Sweden?
Legal Framework for Private Detectives and Surveillance in Sweden
1. Introduction
There is no specific law regulating the profession of ‘private detective’ in Sweden, but the activity is governed by several laws and regulations that apply depending on the type of work performed. Important areas of law include the Criminal Code, the Camera Surveillance Act, the Act on the Processing of Personal Data (GDPR), and regulations on unlawful invasion of privacy.
2. What does the law say about private investigators?
Private detectives are not a protected title in Sweden and no special license is required to work as such. However, private detectives may not use coercive measures or conduct activities that violate other laws such as the Personal Data Protection Act (GDPR), the Criminal Code or the Act on Unlawful Intrusion into Integrity (Chapter 6, Section 1, BrB).
3. Security personnel are not allowed to conduct reconnaissance
According to Section 1 of the Security Company Act (1974:191), security personnel may only perform tasks related to protection and surveillance. Surveillance missions aimed at obtaining information about a person's activities or private life are not considered surveillance, but rather detective work, which is not covered by the Act and therefore may not be carried out within the scope of an authorized security company's mission.
4. When is it legal to hire a private investigator?
It is legal to hire a private investigator in Sweden as long as it is done within the framework of applicable legislation. This includes:
– Surveillance in a public place
– Collection of publicly available information (OSINT)
– Observation and documentation of, for example, infidelity or refusal to work
However, the detective may not:
– Intercept telephone conversations (BrB Chapter 4, Section 9a)
– Trespassing into homes or private spaces
– Filming or taking photos through windows into homes (may constitute offensive photography according to BrB Chapter 4, Section 6a)

– Företag kan anlita detektiver för arbetsrättsliga utredningar, misstänkt illojalitet, sjukskrivningskontroller m.m.
– Privatpersoner kan anlita för exempelvis otrohetsutredningar, vårdnadstvister, bakgrundskontroller
– Allt arbete måste ske inom lagens ramar – kunden har också ansvar att inte uppmana till brott
– Information som samlas in kan användas som stöd i domstol, förutsatt att den är insamlad lagligt
